AOBH and threats to distribute intimate images charges dropped; substantial costs order awarded
This matter involved allegations of assault occasioning bodily harm (AOBH) and a charge of threats to distribute an intimate image. The allegations arose from a domestic dispute involving an acrimonious break-up. We had the matter listed for trial allocation to obtain full disclosure and better understand the case against the client.
On review of the evidence it was plain the client had a strong defence to each of the charges. We appeared for the client at the next appearance and had the matter listed for trial.
Unfortunately, the matter was listed in a regional court which required that the client be responsible for the firm’s travel fees. These can be substantial in a given case depending on how many days we are required to remain in the regional location, and hotel and hire car availability.
We fully prepared for the trial and travelled to the regional location fully prepared to proceed to trial. On the morning of trial, the prosecution dropped both of the allegations our client.
This was a fantastic account as it confirmed our advice that there was no real case against the client. Further, the court ordered a substantial amount of costs which covered almost 100% of the client’ s legal fees including the costs of us travelling to and remaining at the regional location for the trial. The client was very happy with this outcome and thanked the firm for our outstanding service.
